Taylor of Norwell, <br /> Massachusetts for a Special Permit under Section 174-20 of the Zoning By-laws <br /> for permission to demolish an existing dwelling to allow for construction of a <br /> p g g <br /> single-family home on property located in an R-3 zoning district at 112 Waterway <br /> (Map 105 Parcel 219) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 23 and <br /> November 30, 2001, a copy of which is attached hereto and made a part hereof. <br /> I <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 12, 2001, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G. Nelson, Frederick R. <br /> Borgeson and Marshall A. Brem. <br /> I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> submitted photos of the existing dwelling on the subject property and a copy of the <br /> proposed extensive landscaping plan. Mr. Sanicki said that plans call for demolition of <br /> the existing dwelling to be replaced with a new three-bedroom home. <br /> The Board of Health has approved installation of a new septic system. The <br /> Conservation Commission has also approved the project. The Zoning Board of Appeals <br /> granted the Petitioner permission to vary the front setback and lot coverage requirements <br /> and the setback requirements to water and wetlands to allow for construction of the new <br /> home on the subject property. <br /> Mr. James H. Mitchell, an abutter at 106 Waterway, indicated that he was not in <br /> opposition to the proposal as long as there is no need for Variance relief from the side <br /> setback requirements to allow for the project. <br />
