Taylor V-01-133 112 Waterway <br /> Map 105 Parcel 219 <br /> A Petition was filed on November 9, 2001 by Carol A. Taylor of Norwell, <br /> Massachusetts for a Variance from Sections 174-31 and 174-33 of the Zoning By-laws <br /> to modify the front setback and lot coverage requirements and the setback requirements <br /> to water and wetlands to allow for construction of a single-family home on property <br /> located in an R-3 zoning district at 112 Waterway (Map 105 Parcel 219) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 23 and <br /> November 30, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> December 12, 2001, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert G. Nelson, Frederick R. Borgeson <br /> and Marshall A. Brem <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> submitted photos of the existing dwelling on the subject property and a copy of the <br /> proposed extensive landscaping plan. Mr. Sanicki said that plans call for construction <br /> of a new three-bedroom home to replace the existing dwelling. The Zoning Board of <br /> Appeals granted the Petitioner a Special Permit to allow for demolition of the existing <br /> dwelling. <br /> The Board of Health has approved installation of a new septic system. The <br /> Conservation Commission has also approved the project. <br /> Mr. James H. Mitchell, an abutter at 106 Waterway, indicated that he was not in <br /> opposition to the proposal as long as there is no need for Variance relief from the side <br /> setback requirements to allow for the project. <br /> Ij <br /> i <br />
