(Owner of <br /> record: Helen R. Alish.) <br /> At the Public Hearing on Wednesday, August 12, 1998,the Board of Appeals <br /> voted unanimously to grant the Variance. The permit is conditioned upon compliance <br /> with plans of Cape & Islands Engineering dated January 13, 1998, including updated <br /> revisions reducing the lot coverage from 26%to 22% by eliminating the farmer's porch. <br /> On May 25, 1999,the Board of Appeals received a request from the applicant for <br /> a minor modification of the Variance (V-98-95). The applicant proposes to eliminate the <br /> deck and replace it with a farmer's porch. The lot coverage will remain at 22%. <br /> At the Public Hearing on Wednesday, June 9, 1999, the Board of Appeals voted <br /> unanimously to grant the Minor Modification of a Variance. <br /> On July 21, 1999,the applicant submitted a request for a six-month extension of <br /> Variance V-98-95. <br /> At the Public Hearing on August 11, 1999 the Board of Appeals voted <br /> unanimously to grant an extension of the above-referenced Variance. This was allowed <br /> in compliance with Massachusetts General Laws Chapter 40A, Section 10, which reads <br /> "If the rights authorized by a variance are not exercised within one year of the date of <br /> grant of such variance such rights shall lapse;provided, however, that the permit granting <br /> authority in its discretion and upon written application by the grantee of such rights may <br /> extend the time for exercise of such rights for a period not to exceed six months; and <br /> provided, further,that the application for such extension is filed with such per <br /> granting authority prior to the expiration of such o period". <br /> IN FAVOR: ; <br /> IN FAVOR: n <br /> IN FAVOR: 91 `P1 14d € NV 66 <br /> i <br />
