Lipnosky SP-99-57 123 James Circle Map 64 Block 67 A Petition was filed on June 16, 1999 by Andrew J. Lipnosky, Trustee, Lipnosky Family Trust, for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for permission to construct a pier on John's Pond on property located in an R-5 zoning district at 123 James Circle (Map 64 Block 67)Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on June 29 and July 6, 1999, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, July 14, 1999, at which time the following members of the Board of Appeals were present and acting throughout: James E. Regan III, Robert G.Nelson and James M. Dorgan. This Decision is issued by the Mashpee Board of Appeals pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. Mr. Lipnosky represented his application and stated that the Conservation Commission has approved the project. Mr. Lipnosky stated that he was instructed by the Conservation Commission to preserve as much as possible of the natural vegetation leading to the pier. The Harbormaster has approved the project. Mr. David Ferreira, an abutter, expressed concerns about noise and inquired if the pier could be relocated. Mr. Lipnosky stated that he is complying with the Conservation Commission's orders on the location of the pier. No other comments were received from abutters. i i i i i
