g ``Enu�rN� <br /> Town of Mash ee <br /> 16 Great PAeck Aeoad,North <br /> BOARD OF APPEALS <br /> Mashpee, Massachusetts 62649 <br /> Decision for a Minor Modification of a Variance <br /> RE: Terry Luff V-99-23 Map 65 Block 41A/Map 65 Block 40A <br /> 152/156 Algonquin Avenue <br /> A Petition was filed on February 12, 1999 by Terry Luff of Osterville, <br /> Massachusetts for a Variance from Section 174-31 and from Section 174-33 of the <br /> Zoning By-laws for permission to vary the front setback requirements and to varythe <br /> setback requirements from the wetlands on property located in an R-3 zoning district at <br /> 152 and 156 Algonquin Avenue (Map 65 Block 41A and Map 65 Block 40A), Mashpee, <br /> MA. (Owner of record: Henry C. Labute, c/o Cape Cod Bank& Trust, Hyannis, MA). <br /> At the Public Hearing held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 14, 1999,the Board of Appeals voted unanimously to grant the <br /> Variance of 10 feet from the front setback requirements and a Variance of 10 feet from <br /> the sideline setback requirements. <br /> On May 27, 1999,the Board of Appeals received a request from the applicant for <br /> a minor modification of the Variance (V-99-23). The applicant is seeking permission to <br /> relocate the house from the original Cape &Islands plan, being Plan No. 5020299, dated <br /> February 2, 1999, and revised April 2, 1999. <br /> A Public Hearing was held on the Petition on Wednesday, June 9, 1999. The <br /> applicant submitted revised plans of the location of the house. The Board of Appeals <br /> voted to continue the hearing until June 23, 1999 to allow the applicant to submit revised <br /> stamped engineer plans. <br /> At the Public Hearing on June 23, 1999,the applicant was not present and the <br /> Board voted to continue the hearing until July 14, 1999. <br /> At the Public Hearing on Wednesday, July 14, 1999,the Board of Appeals voted <br /> unanimously to grant the Minor Modification of the Variance (V-99-23). The Board <br /> granted a Variance of 8 feet from the rear setback requirements from the wetlands and a <br /> Variance of 10 feet from the front setback requirements.
