The Property, located at 11 Taffrail Way, New <br /> Seabury and as shown on Assessor's Map 106, Block 7, is a 13,560 square foot lot <br /> owned by Kenneth Litvack. The Property is improved with a single-family <br /> dwelling. With this letter is the completed building permit application for the <br /> garage. This present submittal is filed with your office as a new complete building <br /> permit application. <br /> Under current zoning, the Property is located in a R-3 zoning district, which <br /> has a 40,000 square feet minimum lot size. Mashpee Zoning Bylaw, §174-31. <br /> However, based upon the information provided to our office, the lot was created by <br /> a 1963 subdivision of land. Accordingly, the Property is a pre-existing, <br /> nonconforming lot, permissible under the Mashpee Zoning Bylaw ("Mashpee <br /> Zoning"), which was originally approved at Special Town Meeting held on May 7, <br /> 1979. <br /> If compared to present-day zoning, the proposed garage structure would not <br /> comply with (1) the front-yard setback requirement, (2) the 20% lot coverage limit <br /> and (3) the zoning wetlands 50 foot setback. In particular, the garage structure will <br /> be located 20 feet from the front yard line, total tot coverage would be 21% and a rear <br /> corner of the garage would be located 9.1 feet from coastal bank. <br /> Southeastern Mass.
