Said decision unlawfully, in excess of the Board's authority, and against the right of the <br /> plaintiffs, purports to permit the defendant, Fred Glass, to engage in construction and site <br /> work which violates the terms of the Mashpee zoning by-law, and which would be <br /> unlawful absent the grant of a variance from the Zoning Board of Appeals. <br /> 8. The decision of the Zoning Board of Appeals attached hereto as <br /> Exhibit "A", exceeds the authority of the Board, was granted in violation of the plaintiffs' <br /> rights to notice and an opportunity to be heard, is invalid on its face, and should be <br /> annulled.
