Biknaitis V-99-89 31 Amy Brown Road <br /> Map 109 Block 5 <br /> A Petition was filed on September 20, 1999 by Joseph M. Biknaitis of Mashpee, <br /> Massachusetts for a Variance from Sections 174-31, 174-32 and 174-33 of the Zoning <br /> By-laws for permission to vary the front setback requirements, to vary the setback from <br /> the water and the wetlands and to vary fire protection access to allow for construction of <br /> a single-family home on an unpaved road on property located in an R-3 zoning district at <br /> 31 Amy Brown Road (Map 109 Block 5)Mashpee, MA. (Owner of record: Joseph M. <br /> Biknaitis and Vytenis Bichnevicius). <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 8 and October 15, <br /> 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 1999, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G.Nelson <br /> and Richard T. Guerrera. Mr. Regan announced that this is a Chapter 112 Hearing. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicant and <br /> stated that the Conservation Commission has granted a Variance of ten feet to the top of <br /> the coastal bank. He withdrew the request for a Variance from the setback requirements <br /> from the water and the wetlands. Mr. Slavinsky said that the proposed construction also <br /> meets the sideline setback requirements. <br /> Mr. Regan read a letter from the Fire Department with concerns regarding access <br /> to the home with fire and emergency apparatus. Mr. Regan stated that Amy Brown Road <br /> has been widened and gravel has been laid down to improve the condition of the road. <br />
