Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 8 and October 15, <br /> 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 1999, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert G.Nelson, Richard T. Guerrera <br /> and Marshall Brem. Mr. Regan stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Jackunas represented his application and stated that when he purchased <br /> the home a year ago there was an existing apartment with separate utilities in the <br /> basement. He stated that when he made the second-floor addition to the home,the <br /> Building Department discovered that the former owner had not applied for a Building <br /> Permit to install the basement apartment. Mr. Jackunas is seeking permission to keep the <br /> basement as a separate apartment. <br /> Mr.Nelson questioned how the outside is accessed and whether or not it has the <br /> appearance of a single-family home. Mr. Jackunas said that there is a six-foot slider and <br /> a door in the basement leading to the outside. Building Inspector Russell W. Wheeler <br /> confirmed that the dwelling does give the appearance of a single-family home. <br />
