Town of Mashpee MASHPEE ZONING BOARD OF APPEALS 16 Great Jlreck load Vorth N "^% Decision for a Variance Mashpee, Massachusetts 02649 RE: John J. and Patricia Curley V-99-91 100 Uncle Percy's Road Map 117 Block 246 A Petition was filed on September 13, 1999 by John J. and Patricia Curley of Mashpee, Massachusetts a Variance from Section 174-31 of the Zoning By-laws for permission to vary the front setback requirements to allow for construction of an addition to an existing home on property located in an R-3 zoning district at 100 Uncle Percy's Road(Map 117 Block 246)Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on October 8 and October 15, 1999, a copy of which is attached hereto and made a part hereof. ' A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, October 27, 1999, at which time the following members of the Zoning Board of Appeals were present and acting throughout: James E. Regan III, Robert G.Nelson and Frederick R. Borgeson. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of Mashpee Zoning By-laws. Mr. Curley represented his application and stated that the small cottage currently has two small bedrooms. The cottage has been in his family for over 30 years and Mr. Curley owns it jointly with his wife and his sister. The addition to the front of the home would be 10 feet by 29 feet and consist of a bedroom and a screened-in porch to accommodate their growing families. Mr. Curley said that a front setback Variance is being sought. The Conservation Commission and the Board of Health have approved the project. No comments were received from abutters.
