V-99-92 19 Wessagusset Avenue <br /> Map 65 Block 37E <br /> A Petition was filed on September 14, 1999 by Lohr& Sons, Inc. of Mashpee, <br /> Massachusetts for a Variance from Section 174-32 of the Zoning By-laws for permission <br /> to construct a single-family home on an unpaved road on property located in an R-3 <br /> zoning district at 19 Wessagusset Avenue (Map 65 Block 37E)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 8 and October 15, <br /> 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 1999, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G.Nelson <br /> and Richard T. Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Wesley A. Lohr represented the application. He submitted site plans and <br /> photos of the lot, sections of which are not within 150 feet of a paved road. <br /> Mr. Regan read a letter from the fire department with concerns regarding access <br /> to the home with fire and emergency apparatus. Mr. Lohr stated that the road is in good <br /> condition, is wide enough and has enough overhead clearance to allow for access of fire <br /> and emergency apparatus. He also informed the Board that the lot is in the center of two <br /> roads that can be used to access the home. <br /> An abutter, Jim Healy, called the Zoning Board of Appeals office concerned with <br /> construction that had been started on the subject lot prior to the Zoning Board of Appeals <br /> hearing. Construction was stopped and will not commence until after Board approval. <br /> No other comments were received from abutters. <br />
