Town of Mashpee <br /> 16 Great Xeck Poad Xorth <br /> BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Special Permit <br /> RE: William &Mary Henney SP-98-129 19 Birch Way <br /> Map 27 Block 89 <br /> A Petition was filed on August 19, 1998 by William and Mary Henney of <br /> Mashpee, Massachusetts for a Special Permit under Section 174-25.1.9 of the Zoning By- <br /> laws for permission to construct a pier, ramp and float on Mashpee Pond on property <br /> located in an R-5 zoning district at 19 Birch Way (Map 27 Block 89), Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 25 and October <br /> 2, 1998, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 14, 1998, at 7:30 P.M,, at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govom, James E. <br /> Regan III and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape& Islands Engineering represented the applicants who <br /> propose to construct a dock in Mashpee Pond. The dock will be supported by pipes and <br /> will be seasonally removed. Lateral access along the waterfront will be provided by a <br /> stairway on either side of the dock. The Conservation Commission and the Harbormaster <br /> have approved the project. No comments were received from abutters, <br />
