Board of Appeals Half Tide Marina SP-98-136 2 <br /> FINDINGS <br /> Cieneral Finding <br /> 1. the subject property is located at 2 Great Neck Road North and consists of <br /> 25,852 square feet. <br /> Special Permit Criteri <br /> Section 9 of Chapter 40A and Section 174-24.C. of the Mashpee Zoning By-laws <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law, rules and regulations'that there will be <br /> no adverse effect on public health or safety;that there will not be an excessive demand <br /> upon community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C.2. <br /> Specific Finding <br /> I. the Board denied, Aithout prejudice, Mr. Scozzari's request for a Variance. <br /> 2. the volume of traffic will increase considerably at the intersection and will be <br /> a major safety concern. <br /> 3. the Board determined that relief could not be granted without detriment to the <br /> public good. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> failed to meet the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Board of Appeals voted unanimously on October 14, 1998 <br /> to deny, without prejudice, Mr. Scozzari's request for a Special Permit. <br />
