REGARDINlip <br /> G: ' 11ryr <br /> Reference is made to a Special Permit Decision issued by the Mashpee Planning Board, <br /> dated April 15, 1987 and recorded with the Barnstable County District Registry of <br /> Deeds at Book 5707, Page 290, as amended from time to time (hereinafter the "Special '' 6,. �,. <br /> Permit"). By decision dated August 7, 1991, the Special Permit was transferred to it '` <br /> Not <br /> Bent Twig Limited Partnership whose interest was subsequently assigned to <br /> Willowbend Development Corporation. Willowbend Development Corporation is <br /> SII: <br /> hereinafter referred to as the "New Owner" or "applicant". The Special Permit <br /> authorizes construction of a residential/golf course community known as Willowbend <br /> south of Route 28 in East Mashpee (the "Project"). <br /> H. JURISDICTION: <br /> This modification is issued pursuant to Sections 9.3 and 9.4 of the Mashpee Zoning <br /> By-Law as they existed on November 6, 1985 and applicable provisions of M.G.L. <br /> Chapter 40A, Section 9. <br /> I pt t,plll� <br /> III. FACTS AND FINDINGS: <br /> h' <br /> At a public hearing held on May 1, 1996 and continued to May 15, 1996, the applicant <br /> presented the Planning Board with a proposed further modification to the Special ' <br /> Permit Plans showing a modified site plan in the area of the existing fitness center „ <br /> complex. The proposed modification shows additional parking and landscaped areas to 0 <br /> the east of Simons Road and west of the real estate and development offices as well as <br /> the proposed site of a future basketball court and indoor tennis facility. The applicant ' �""`' <br /> is also seeking formal approval, to the extent required, of the relocated real <br /> estate/construction office. The modifications to the approved Special Permit Plans are „ <br /> shown on a plan entitled "Fitness and Recreational Expansion Plan, prepared for <br /> Willowbend Development Corp., dated April 26, 1996, a copy of which was filed with <br /> the Board. <br /> The applicant explained that the changes are being provided to satisfy existing and <br /> prospective residents who have expressed the desire to have additional fitness oriented <br /> community facilities. The Board finds that extensive landscaping will be provided to ..?'' <br /> screen the proposed changes from adjacent roads and that the additional parking will 4LiN a�, <br /> lessen demand for spaces in and around the clubhouse.
