'a a. �+ Attorney Ford wanted to clarify that the unit owners either <br /> expect or desire to have .their units be the only ones out there, <br /> because they don' t. They all bought subject to a plan and they <br /> all fully expected that at some point that (referring to the <br /> .� original plan) would be built and it never has been. The unit <br /> owners are here to tell the Board that the proposed plan is not <br /> what they bought into, not what they anticipated and not what <br /> they are here to support. If anything, they would ask the Board <br /> ►;'� to turn that down and ask Mr. Bornstein to start over. Attorney <br /> Ford then stated that they are willing to work during a continued <br /> period to see if there can be some resolution. <br /> VQ The Chairman recognized Attorney Butler who stated that the <br /> Special Permit did not lapse, and that he would be happy to <br /> provide the Board with a much more thorough letter on the issue. <br /> Attorney Butler pointed out there had been substantial <br /> construction that occurred on-site unrelated to these fourteen <br /> units. The leaching system, the piping system, the <br /> infrastructure, the pavement, all of those things to deal with <br /> just about the entire project, or at least up to fifteen thousand <br /> 0; 44IgM gallons per day was constructed as part of the original <br /> construction. He then addressed the issue of jurisdictional <br /> .11 determination by saying the Planning Board certainly has the <br /> •r * iE right. <br /> Attorney Butler further stated that since the date of the <br /> letter from Margo Fenn, he has spoken with Patty Daily to review <br />' the letter and the policy, and a determination was made, at least <br /> A � at that point in time, that there was no feeling that this <br /> project fell within the confines of that particular. . . <br /> The Chairman interrupted to ask if she had seen the plans. <br /> Y•.a�' <br /> Attorney Butler answered, "I did not have the plans with me <br /> Wr.• rl ' when I met with her.
