Brooks Jr . for a special Permit <br /> SP-93-104B <br /> A Petition was filed by Thomas W. Brooks Jr . of Mashpee, <br /> Massachusetts for a Special Permit under Sections 174-17 , <br /> 174-31 , 174-12 , and 174-32 of the Zoning By-laws for <br /> permission to expand a non-conforming dwelling with a 7 . 5 ' x <br /> 24 ' house addition and an 8 ' x 11 ' deck in an R-5 Zoning <br /> district on property located at 15 Sturgis Lane (Map 20 , Block <br /> 27 ) Mashpee, MA. ( Owner of record: Richard C. and Daniel M. <br /> Desantis ) . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise , a newspaper of general <br /> circulation in the Town of Mashpee , on November 19 and <br /> November 26 , 1993 , a copy of which is attached hereto and made <br /> a part hereof . <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall on Wednesday, December 8 , 1993 at 7 : 30 P .M. at which <br /> time the following members of the Board of Appeals were <br /> present and acting throughout : John J . Friel , Michael A.. <br /> Makunas and Jamie Regan . <br /> Mr . Brooks informed the Board that he had recently <br /> purchased the property which included two residences and dock <br /> bordering Mashpee Pond. He explained that both houses <br /> required repairs and that the Building inspector had suggested <br /> that the Permit be applied for under several by-laws . The <br /> Board determined that the Permit for licensing the existing <br /> dock should be handled in a separate Decision. <br /> The Board determined that the planned construction was in <br /> harmony with the general purpose and intent of the by-laws and <br /> complied with the provisions therein . The Board found that <br /> the proposed expansion would not be a detriment to the <br /> neighborhood. <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously on December 8 , 1993 to grant the Special <br /> Permit . The Permit is referenced by plans Christopher Costa <br /> revised October 27 , 1993 . <br />
