Cloran - V-91-18 <br /> A Petition was filed by Urban and Francis T. Cloran of Mashpee, <br /> Massachusetts for a Variance under Section 174-31 of the Zoning <br /> By-laws for permission to vary the setbacks in an R-3 zoning district <br /> on property located at 156 Shore Drive (Map 123, Block 158) Mashpee, <br /> Massachusetts. (Owner of record: H. Frances T. Cloran) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on December 21 and December 28, 1990, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, January 9, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. <br /> Hanrahan. <br /> Engineer Scott McAskill represented the applicant. He presented <br /> plans for a proposed home on a corner lot and said plans required a <br /> 32.70' front set back from Shore Drive and a 25. 18' set back from <br /> Beach Road with proposed lot coverage of 10.67%. He explained that <br /> the topography of the lot did not permit any other location for the <br /> house. <br /> The Board found that there were circumstances relative to the shape <br /> and topography which specifically affected the land in question but not <br /> the zoning district in which the land was located and that a literal <br /> enforcement of the by-laws would involve substantial hardship. The <br />'i Board determined that relief could be granted without derogating from <br /> the intent of the by-laws or detriment to the public good. <br />
