MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: PECO INC. for a Variance - V 91-34 <br /> A Petition was filed by PECO Inc. of Brockton, Massachusetts <br /> for a•,Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the front setback requirements for corner lots <br /> in an R-5 zoning district on property located at 84 Shields Road <br /> (Map 30, Block 12A) Mashpee, MA. (Owner of record: Paul J. Hartel <br /> and William W. Peters Jr.) <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the .Town of Mashpee, <br /> on May 24 and May 31, 1991., a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, June 12, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. <br /> Hanrahan. <br /> Engineer Christopher Costa represented the applicant and <br /> explained that the lot in question bordered a paper road which had <br /> been deeded to the Town for conservation use. He stated that the <br /> shape and topography of the lot prevented house placement with <br /> front setbacks on two sides. <br /> The Board found that the shape and topography of the lot created <br /> a hardship affecting the land in question but not the zoning district <br /> in which the land is located. The Board determined that relief could <br /> be granted without derogating from the intent of the by-laws and without <br /> detriment to the public good. <br />
