Wachtenheim for a Special Permit SP-91-61 <br /> A Petition was filed by Stanley J. and Mindy S. Wachtenheim of <br /> Providence, Rhode Island, for a Special Permit under Section 174-17 <br /> of the'Zoning By-laws for permission to expand a non-conforming <br /> structure with the replacement of a house and garage in an R-3 <br /> zoning district on property located at 78 Popponesset Island Road <br /> (Map 106, Block 30) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 4 and October 11, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, October 23, 1991 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William J. Hanrahan, Michael A. Makunas and Cheryl A. Hawver. <br /> Attorney Kevin Kirrane represented the applicants and presented <br /> plans for the replacement of a seasonal house and garage with a year- <br /> round structure. He explained that the new location of the home met <br /> the side and rear setback requirements and conformed to the lot coverage <br /> but that a Variance would be required for the front set-back. He <br /> informed the Board that the Conservation Commission had requested that <br /> the buildings be reconstructed closer to Popponesset Island Road to <br /> preserve the coastal bank. No comments were received from abutters. <br /> The Board found that the use is in harmony with the purpose and <br /> intent of the By-laws and complies with the provisions therein and that <br /> the extension would not be more detrimental to the neighborhood than <br /> the existing nonconforming use. <br />
