Wachtenheim for a Variance V-91-60 <br /> A Petition was filed by Stanley J. and Mindy S. Wachtenheim of <br /> Providence, Rhode Island, for a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the front set-back requirements <br /> in an R-3 zoning district on property located at 78 Popponesset <br /> Island Road (Map 106, Block 30) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 4 and October 11, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, October 23, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Michael A. Makunas and Cheryl A. <br /> i Hawver. <br /> Attorney Kevin Kirrane represented the applicant and presented <br /> plans for the removal of a seasonal house and garage and replacement <br /> ti with a year-round home and garage. He informed the Board that the <br /> Conservation Commission had requested location of the home closer to <br /> Popponesset Island Road to provide maximum distance from the coastal <br /> I <br /> i bank. No comments were received from abutters. <br /> The Board found that the proximity to the coastal bank created <br /> a hardship affecting the land in question but not the zoning district <br /> i <br /> in which the land is located and that relief could be granted without <br /> derogating from the intent of the By-laws or without any detriment <br /> to. the public good. <br /> I <br /> A <br />
