11 <br />Mashpee Select Board <br />Minutes <br />March 21, 2022 <br />Presentations on Petition Articles: Tax Cap: Timothy Martin: (continued) <br />The Select Board in considering their position on the petition article disclosed that Town Counsel has advised the <br />article as presented proposes a local taxation measure and by legal standards and criteria, the article is deemed <br />null and void, and it is therefore invalid. The Select Board and Town Manager expressed appreciation to Mr. <br />Martin from bringing this matter to their attention. The matter was taken under advisement at this time. <br />Discussion and Action on Draft #3 May 2 2022 Special and Annual Town Meeting Warrant: <br />The Select Board received correspondence from Terrie M. Cook dated March 17, 2022 regarding action items <br />required to be voted upon on this date to meet the posting requirements of the May 2, 2022 Special and Annual <br />Town Meeting Warrant. Action was taken as follows; <br />Special Town Meeting -Warrant: <br />Article 1: To appropriate funds to the Snow & Ice Account. Amount not determined. <br />Motion made by Selectman Gottlieb to appropriate a sum of money not to exceed $300,000 to fund the <br />projected deficit in the Snow & Ice Account. <br />Motion seconded by Selectman Cotton. <br />VOTE: Unanimous. 5-0. <br />Roll Call Vote: <br />Selectman Sherman, yes Selectman Weeden, yes Selectman Gottlieb, yes <br />Selectman Cotton, yes Selectman O'Hara, yes Opposed, none <br />Motion made by Selectman Gottlieb to include and support Article I as presented. <br />Motion seconded by Selectman Cotton. <br />VOTE: Unanimous. 5-0. <br />Roll Call Vote: <br />Selectman Sherman, yes Selectman Weeden, yes Selectman Gottlieb, yes <br />Selectman Cotton, yes Selectman O'Hara, yes Opposed, none <br />Article 20: To appropriate Design & Engineering funds to estimate total construction costs to implement <br />Phase II of the Mashpee Clean Water Plan. <br />Two bids were received in response to the Request for Proposal (RFP). Due to the lack of clarity and precision in <br />the RFP process, the timing and the need to further review the process internally the Town Manager <br />recommended deferral of this article. The Select Board took the following action with anticipation the article <br />would be placed on the October 2022 Town Meeting warrant for funding consideration. <br />Motion made by Selectman Gottlieb to remove Article 20 from the Special Town Meeting warrant. <br />Motion seconded by Selectman Cotton. <br />VOTE: Unanimous. 5-0. <br />Roll Call Vote: <br />Selectman Sherman, yes Selectman Weeden, yes Selectman Gottlieb, yes <br />Selectman Cotton, yes Selectman O'Hara, yes Opposed, none <br />
