16 Great Neck RoadWorth <br />Mashpee, Massachusetts 02649 <br />MOTION: <br />Ms. Faulkner made a motion to have Town Counsel clarify to the Planning Board what <br />Section 174-40: Access Ways in Non Residential districts means and to explain. <br />Seconded by Mr. Balzarini. All in favor. <br />MOTION: <br />Mr. Balzarini made a motion to authorize the Town Planner to talk to the owners of <br />Nicolettas Way and update the Select Board. Seconded by Ms. Faulkner. All in favor. <br />Mr. Lehrer stated this is a dual step process. First the town would take a vote to authorize the <br />Select Board to lay out the streets and prepare the plan, and at the subsequent Town Meeting, <br />the town votes to accept the layout after the Planning Board reviews the plan. It requires two <br />Town Meetings. <br />Mr. Balzarini stated this may not be something Nicolettas Way would be on board with, and <br />could be contemplated if there was a safety issue. <br />Ms. Waygan moved on to traffic and stated Mr. Lehrer drafted up a motion. <br />MOTION: <br />Mr. Balzarini made a motion to seek a traffic engineering and transportation planning <br />consultant in accordance with Ma General Law 44, Section 53G and the Town of <br />Mashpee rules and regulations governing the subdivision of land, for the review of the <br />proposed 532 Main Street, Leamar Drive definitive subdivision submitted by Marcello <br />Mallegni property owner, consistent with the scope of work outlined in the request for <br />quote prepared by Town Planner, Evan Lehrer and distributed to qualified firms for <br />solicitation dated October 11, 2022. Furthermore, to authorize the Town Planner to <br />request payment from the applicant in the amount not to exceed the lowest quoted price <br />from a qualified bidder. The Board also authorizes the Town Planner to slightly modify <br />the scope after discussing with project proponents and traffic engineer if necessary. <br />Seconded by Ms. Faulkner. All in favor. <br />Mr. Kirrane asked if they could include something in the motion. They haven't reviewed the <br />scope, but if there were any questions or requests to change or limit the scope, instead of <br />coming back before the entire Board, could they leave modifications to the discretion of the <br />Town Planner. This was added to the motion above. <br />Mr. Lehrer stated the Board has all quotes that have been provided thus far, he will provide <br />them to the Board digitally as well, and keep the Board informed of the last bid.
