Having ascertained that this action was the free act and deed of the Planning <br /> Board the Board Secretary notarized three-copies of"Release of Covenant Agreement <br /> Bayswater Flat Pond, LLC—New Seabury Properties" signed by Beverly A, Kane, <br /> Dennis H. Balzarini, and Thomas F. O'Hara. <br /> Correspondence <br /> Letter from Douglas S. Storrs, Mashpee Commons LP,dated April 30,2008, <br /> addressed to Ms. Beverly Kane, Chair,, Mashpee Planning Board,regarding a long-range <br /> planning process and Development Agreement. <br /> The Town Planner informed the Board that the Board of Selectmen has endorsed <br /> the concept of organizing of a Study Committee. A Development Agreement would be <br /> prepared under the Cape Cod Commission Act whereby the Developer, Town,and Cape <br /> Cod Commission would enter into an agreement with regard to long-range planning and <br /> development issues for a large portion of land that is to be developed in phases. The <br /> Town has adopted a Zoning Bylaw relative to the way Development Agreements are <br /> prepared and requires the Planning Board to act on behalf of the Town, and to be signed <br /> by the Board of Selectmen upon completion. <br /> There was some discussion regarding the process, the Chairman feels very <br /> strongly that the matter of the Development Agreement issues should be discussed at a <br /> regularly scheduled Planning Board Meeting, Public Hearing process. <br /> The Town Planner volunteered to provide copies of the Zoning Bylaw he refeffed <br /> to earlier for Planning Board review. <br /> Discussion <br /> ABKJJT, LLC—9-Lot ANR <br /> The Town Planner informed the Board that the Cape Cod Commission has made a <br /> decision to accept the mandatory DRI referral in this matter and have made notification to <br /> the Developer. The 2 1-day AMR review requirements have been staid. <br /> Reference was made to a letter prepared by Attorney Kevin Kirrane addressed to <br /> the Cape Cod Commission arguing that this matter should be exempt from the DRI <br /> process. <br /> "I'be Cape Cod Commission will review and determine impacts as well as traffic <br /> and water quality mitigation. <br /> Thomas O'Hara requested clarification of the 40-B Housing regulation as he is <br /> concerned about the industrial use portion of the project. <br /> A <br />
