0 <br />Mashpee Select Board <br />Minutes <br />April 24, 2023 <br />APPOINTMENTS & HEARINGS <br />Public Hearin _,&pptinued from, arch t3 2023 ; Discussion and Vote Relative to„the Removal <br />of Mohamad Fa <br />nd from the Mash p ee Commum vGarden Advisory Committee Pursuant to Mashpee <br />Charter. Sectionm7-9 q (continued) <br />Under Section 7-9: Removals and Suspensions a member of a multiple member body may, for good cause, be <br />suspended or removed from office... <br />The limit of the Select Board's authority lies under Section 7-9. It was recommended that protocols with the <br />advice of Town Counsel would be considered at a future meeting <br />As the Select Board continued their discussion, appreciation was given to all volunteers. <br />It was noted the term of Mr. Fand from the MCGAC is due to expire in June 30, 2023. Mr. Fand was asked if <br />he would choose to resign. If so, the Select Board would not have to cast a vote. There was no action. <br />Motion made by Selectman Cotton to close the Public Hearing. <br />Motion seconded by Selectman O'Hara. <br />VOTE: Unanimous. 5-0. <br />Roll Call Vote: <br />Selectman Weeden, yes Selectman Cotton, yes Selectman O'Hara, yes <br />Selectman Sherman, yes Selectman Wyman -Colombo, yes Opposed, none <br />Motion made by Selectman Cotton to remove Mohamad Fand as an appointed member of the Mashpee <br />Community Garden Advisory Committee. <br />For point of discussion, the motion was seconded by Selectman Wyman -Colombo. <br />VOTE: 3-2. Motion carries. <br />Roll Call Vote: <br />Selectman Weeden, no Selectman Cotton, yes Selectman O'Hara, yes <br />Selectman Sherman, yes Selectman Wyman -Colombo, no Opposed, (2) <br />It was noted the scope of the removal is based on grounds only, not personalities or gardening practices. This <br />is outside the purview of the Select Board. The Town Manager's Office is retaining all information on file. <br />COMMUNICATIONS & CORRESPONDENCE <br />For the record, the Select Board made public a letter received from the Association to Preserve Cape Cod <br />(APCC) dated April 20, 2023 to Governor Maura Healey and Lt. Governor Kim Driscoll requesting the <br />administration formally evaluate retaining remaining and essential JBCC functions such as the Coast Guard <br />while utilizing the underdeveloped, disturbed areas of the base for much -needed affordable housing to help <br />address the Cape's lack of affordable housing as well as protecting the Upper Cape Water Supply Reserve with <br />a permanent conservation restriction. <br />
