CH40A Section 6 and 17 is still at the discretion of the ZBA and is the same as <br />Raze and Replace. There is a problem with the application specific to the Popponesset <br />Overlay. This article is not for your average raze and replace but for huge expansions. 17.1 <br />enables unusual raze and replaces, it's not concentrated or only applicable to Poppy but will <br />apply across town like Johns Pond and Wakeby Pond, where someone could come in and <br />build a McMansion. <br />Mr. Lehrer states he wants to change the Raze and Replace not repeal. Chapter 40A section 6 <br />functions identically to Raze and Replace but provides more flexibility. He feels the repeal may <br />harm people with plans, but it would be important to deal with the isolated section of <br />Popponesset. He would be concerned with the town voting to repeal this. <br />John Miller- He stated in the twenty years he has been here he never encountered a need to <br />address this. The question is in the confidence level of the ZBA to act in a way that others may <br />feel is not in the best interest. A vote at Town Meeting enhances the likelihood the ZBA will be <br />more thoughtful than they currently are with this in place. If 17.0 allows this to accomplish <br />
