The Board of Selectmen recommends approval of <br />Article 26 by a vote of 4-0 <br />The Finance Committee recommends approval of <br />Article 26 by a vote of 5-0 <br />After holding a public hearing held on October 2, <br />2019, the Planning Board voted unanimously to <br />recommend approval of Article 26 as presented. <br />Motion made and passes to dispense with reading <br />of article at 9:09 PM. <br />MOTION MADE BY SELECTMAN GOTTLIEB: <br />Motion: I move the Town vote to approve Article 26 <br />as printed in the warrant with the exception of the <br />phrase, "or take any other action relating thereto." <br />Motion passed by 2/3 vote at 9:13 pm <br />Article 27 <br />To see if the Town will vote to amend §174-25 (A)(8) <br />of the Mashpee Zoning By Law "Table of Use <br />Regulations" by replacing the letters `SP' located in the <br />columns identified as R-3 and R-5 with a `Y' as <br />follows: <br />T_VpeofUse <br />Residential <br />Cmmnercial <br />Industrial <br />R-3 <br />R-5 <br />C-1 <br />C-2 <br />C-3 <br />1-1 <br />Accessory apartment <br />Y <br />Y <br />-- <br />-- <br />-- <br />-- <br />subjcct to the provisions <br />of § 174-45.4 <br />or take any other action relating thereto. <br />Submitted by the Planning Board <br />Explanation: This article would allow accessory <br />apartments in the residential zoning districts of the <br />Town as a by -right use. <br />The Board of Selectmen recommends approval of <br />Article 27 by a vote of 4-0 <br />The Finance Committee recommends approval of <br />Article 27 by a vote of 5-0 <br />After holding a public hearing held on October 2, <br />2019, the Planning Board voted unanimously to <br />recommend approval of Article 27 as presented. <br />MOTION MADE BY SELECTMAN COTTON: <br />Motion: I move the Town vote to approve Article 27 <br />as printed in the warrant with the exception of the <br />phrase, "or take any other action relating thereto." <br />Motion passed by 2/3 vote at 9:14 pm <br />Article 28 <br />To see if the Town will vote to amend § 174-3 of the <br />Mashpee Zoning Bylaw- Terms Defined as follows: <br />Accessory Apartment - An apartment created within or <br />detached from a single-family residential structure <br />under the provisions of § 174-45.4. <br />Dwelling Accessory - A residence created under the <br />provisions of Section 174- 46B(l), containing no more <br />than two (2) bedrooms, which may have kitchen and <br />bathroom facilities and other rooms <br />which are not bedrooms, either attached to or detached <br />from a principal residence on the same lot and not <br />owned separately from the lot or principal residence. <br />or take any other action relating thereto <br />Submitted by the Planning Board <br />Explanation: This article would change the definition <br />of Accessory apartment in the zoning bylaw to include <br />detached structures. It would also change the definition <br />of Dwelling Accessory in the Open Space Incentive <br />Development (OSID) to allow Accessory Dwellings <br />permitted under OSID to have up to two (2) bedrooms. <br />This would establish consistency with the accessory <br />apartment definition. <br />The Board of Selectmen recommends approval of <br />Article 28 by a vote of 4-0 <br />The Finance Committee recommends approval of <br />Article 28 by a vote of 5-0 <br />After holding a public hearing held on October 2, <br />2019, the Planning Board voted unanimously to <br />recommend approval of Article 28 as presented. <br />MOTION MADE BY SELECTMAN O'HARA: <br />Motion: I move the Town vote to approve Article 28 <br />as printed in the warrant with the exception of the <br />phrase, "or take any other action relating thereto." <br />Motion passes unanimously at 9:16 pm <br />102 <br />
