Report of the <br />Zoning Board of Appeals <br />To the Honorable Board of Selectmen and the <br />Citizens of the Town of Mashpee: <br />The Zoning Board of Appeals is appointed by the <br />Selectmen and acts under the authority of <br />Massachusetts General Laws (M.G.L.) Chapters 40A <br />and 40B and the Town Zoning By-laws. The Zoning <br />Board of Appeals has the following powers: <br />• To hear and decide Appeals in accordance with <br />M.G.L. Chapter 40A §8. <br />• To hear and decide Petitions for Special Permits <br />in accordance with M.G.L. Chapter 40A §9. <br />• To hear and decide Petitions for Variances as set <br />forth in M.G.L. Chapter 40A § 10. <br />• To hear and decide Appeals of a <br />Decision/Opinion of the Building Commissioner <br />in accordance with M.G.L. Chapter 40A § § 13 and <br />14. <br />• To hear and decide Petitions for Comprehensive <br />Permits under M.G.L. Chapter 40B. <br />Meetings of the Zoning Board of Appeals are <br />generally held on the second and fourth Wednesdays <br />of each month at 6:00 p.m. at the Town Hall. These <br />meetings are open to the public. <br />Chairman, Jonathan Furbush is approaching his <br />fifteenth year and continues to provide the Town his <br />tremendous support. Also, Vice Chairman, William A. <br />Blaisdell and Clerk, Ronald Bonvie continue to <br />demonstrate their expertise assisting members of the <br />Board and the Town on all ZBA petitions. The Board <br />welcomed Associate Members, George Ganzenmuller <br />in April, and James Reiffarth who rejoined the Board <br />in June ... welcome back! The Board looks forward to <br />their involvement on future ZBA petitions. <br />The Zoning Board of Appeals heard a total of <br />sixty two (62) Petitions in calendar year 2019. Petition <br />fees and abutter notification fees in the amount of <br />$14,083.00 were collected in 2019. Construction <br />projects included, additions, accessory apartments, <br />demolition/rebuilds, and remodel/renovations. <br />.The Zoning Board of Appeals issued a <br />Comprehensive Permit to Habitat for Humanity under <br />M.G.L. Chapter 40B for the construction of two (2) <br />single-family homes located on Great Neck Road <br />North. <br />The Board granted Special Permits for the <br />following commercial enterprises: <br />• Bridgestone Development, Inc. for 9 Shellback <br />Way <br />• Thomas E. Fair, for 21 Evergreen Circle <br />• RCA Electrical Contractors, for 153 Commercial <br />Street <br />• Four Square Development, LLC, for 31 <br />Mercantile Way <br />• Cape Cod Coffee, for 10 Evergreen Circle <br />The Zoning Board of Appeals thanks Rodney C. <br />Collins, Town Manager, Michael Mendoza, Building <br />Commissioner/Zoning Official, Evan Lehrer, Town <br />Planner, Attorney, Patrick J. Costello, and Attorney, <br />Kathleen Connolly, Town Counsel, for their assistance <br />and advice.
