The Board of Selectmen recommends approval of
<br />Article 8 by a vote of 4-0
<br />The Finance Committee recommends approval of
<br />Article 8 by a vote of 5-0
<br />MOTION MADE BY SELECTMAN O'HARA:
<br />Motion: I move the Town vote to approve Article 8 as
<br />printed in the warrant with the following Bylaw text
<br />modifications:
<br />In Section A, add ", the provisions of G.L.c. 64G, § 14,
<br />and any other enabling authority" after "Home Rule
<br />Authority" in the first sentence.
<br />In Section B.2 (Dwelling), substitute "any facility
<br />licensed under any state housing or local housing laws
<br />or bylaws, including affordable housing facilities" for
<br />,,any licensed facility and/or affordable housing
<br />facilities" at the end of that sentence;
<br />Delete Section B.3 (Licensed Facility);
<br />In Section B.7, delete the existing definition of "Rental
<br />Property" and substitute the following language
<br />therefor: "Rental Property -an owner -occupied, tenant -
<br />occupied, or non -owner occupied property including,
<br />but not limited to, an apartment, house, cottage,
<br />condominium, or furnished accommodation that is not
<br />a hotel, motel, lodging house, or bed and breakfast
<br />establishment where 1) at least one room or unit is
<br />rented to an occupant or sub -occupant for a period of
<br />at one night but not but not more than 31 consecutive
<br />calendar days; and 2) all accommodations are reserved
<br />in advance.";
<br />In Section CA. IV, substitute the clause "within a
<br />reasonable period of time, as defined by Board of
<br />Health regulation." for "within two hours for
<br />emergencies and twelve (12) hours for non -
<br />emergencies of being called";
<br />In Section D.1, fifth sentence, substitute the clause
<br />"within a reasonable period of time, as defined by
<br />Board of Health regulation." for "within two (2) hours
<br />or twelve (12) hours for non -emergency requests for
<br />assistance of any such notification or request";
<br />In Section D.3, substitute the word "examined" for
<br />"inspected";
<br />In Section G.2, substitute "and at intervals so
<br />determined by Board of Health regulation, but not more
<br />than once annually' for the phrase "and annually
<br />thereafter";
<br />In Section H, insert the word "agents" after the word
<br />"authorized";
<br />In Section K.1, substitute "This chapter shall be
<br />enforced by the Inspector of Buildings, Health Agent,
<br />Code Compliance Inspector, or a police officer of the
<br />Town." for the original text;
<br />In Sections K.2 and 3, substitute the word "dwelling"
<br />for "building" in the three places it appears; and
<br />Except the phrase, "or take any other action relating
<br />thereto."

<br />To see if the Town will vote to create a permanent full
<br />time employment position within the Health
<br />Department entitled Code Compliance Inspector,
<br />pursuant to the Personnel Administrative Plan, General
<br />Bylaw Section 5-7 as recommended by the Town
<br />Manager, the duties and responsibilities of which shall
<br />include, without limitation, performing advanced
<br />administrative, technical, inspection and investigative
<br />work related to the enforcement and interpretation of
<br />Town codes, Bylaws, departmental policies and
<br />procedures, related rules and regulations, and
<br />performing varied duties related to application of state
<br />laws, codes and regulations in the Town of Mashpee;
<br />and, further, to appropriate, raise and/or transfer the
<br />sum of $100,473 from revenue available for
<br />appropriation, with said funds to be distributed as
<br />follows: $61,035 to the Health Department
<br />Salary/Wage account, $25,272 to the Medical insurance
<br />account, $35 to the Group Life Insurance account, $885
<br />to the Medicare expense account, and $13,246 to the
<br />Barnstable County Retirement expense account, or take
<br />any other action relating thereto.
