Explanation: The term "existing conditions" is a more <br />appropriate term under the context of this bylaw <br />subsection. <br />The Board of Selectmen recommends approval of <br />Article 22 by a vote of 4-0 <br />The Finance Committee recommends approval of <br />Article 22 by a vote of 6-0 <br />MOTION MADE BY SELECTMAN COTTON: <br />Motion: I move the Town vote to approve Article 22 <br />as printed in the warrant with the exception of the <br />phrase, "or take any other action relating thereto." <br />Motion passes unanimously at 9:06 pm <br />Article 23 <br />To see if the Town will vote to amend Chapter 172-9 <br />of the General Bylaws as follows: <br />Amend the language of 172-9(A) to include the term <br />"Adverse Impact" and its definition as follows: <br />Adverse Impact- Adverse impact means an impact to <br />the value or interest of a wetland resource area as <br />defined by the bylaw that is deemed by the issuing <br />authority to be more than negligible, or random, <br />unnecessary or undesirable to the public interests of <br />the resource area. Negligible means insignificant to <br />the values or interests of the resource area" <br />or take any other action relating thereto. <br />Submitted by the Conservation Department <br />Explanation: The term "adverse impact" is commonly <br />referenced in the regulatory language of the <br />Massachusetts State Wetland Protection Act as a <br />barometer of impact thresholds within wetlands <br />jurisdiction. Adding this definition to Mashpee's <br />Chapter 172 Bylaw will provide consistency of <br />regulatory language and terminology. <br />The Board of Selectmen recommends approval of <br />Article 23 by a vote of 4-0 <br />The Finance Committee recommends approval of <br />Article 23 by a vote of 6-0 <br />MOTION MADE BY SELECTMAN O'HARA: <br />Motion: I move the Town vote to approve Article 23 <br />as printed in the warrant with the exception of the <br />phrase, "or take any other action relating thereto." <br />Motion passes unanimously at 9:07 pm <br />Article 24 <br />To see if the Town will vote to amend Chapter 172-14 <br />of the General Bylaws as follows: <br />Replace any reference to "Office of Energy and <br />Environmental Affairs" and its acronym "OEEA" with <br />"Executive Office of Energy and Environmental <br />Affairs" and its acronym "EOEEA" <br />or take any other action relating thereto. <br />Submitted by the Conservation Department <br />Explanation: The bylaw must accurately reflect any <br />name/acronym changes in reference to other state <br />agencies in the bylaw language. This is housekeeping <br />amendment. <br />The Board of Selectmen recommends approval of <br />Article 24 by a vote of 4-0 <br />The Finance Committee recommends approval of <br />Article 24 by a vote of 6-0 <br />MOTION MADE BY SELECTMAN SHERMAN: <br />Motion: I move the Town vote to approve Article 24 <br />as printed in the warrant with the exception of the <br />phrase, "or take any other action relating thereto." <br />Motion passes unanimously at 9:08 pm <br />Article 25 <br />To see if the Town will vote to amend Section 173-3 <br />(Violations and Penalties) of the General Bylaws by <br />deleting the phrase "not to exceed three hundred <br />dollars ($300) per incident" and inserting "as <br />established by the Board of Selectmen", or take any <br />action relating thereto. <br />Submitted by the Conservation Department <br />
