16 Great Neck Road North <br />Mashpee, Nassachusetts 02649 <br />Ms. Faulkner reiterated Ms. Waygan's previous concern as to how this could be an ANR with <br />lot frontage only being 130ft. when it is supposed to be 150ft. <br />Mr. Lehrer stated there was a variance issue for the parcel in the 90's. It was not recorded in <br />time to be a valid variance. The Planning Board approved the definitive subdivision and it is <br />not on record with the Registry of Deeds as submitted. Frontage as shown is a resultant of the <br />ZBA in 2012, and exists by way of approval in 1999. The submitted ANR does not propose <br />altered footage, it is a land swap of equal land area. <br />Ms. Faulkner asked when the ZBA gives a variance if that limits what the Planning Board can <br />do. <br />Mr. Lehrer answered that the lot area and frontage is consistent with zoning, the Planning <br />Board cannot endorse unless the ZBA approves the variance on record. <br />MOTION: <br />Mr. Richardson made a motion to recommend the endorsement of the ANR. Seconded <br />by Mr. Balzarini. All in favor. <br />Mr. Lehrer asked that every member sign the mylar on the front table. <br />NEW BUSINESS <br />Vote to set public hearing date for an application submitted by Pleasantwood Homes <br />LLC for a cluster development special permit and definitive subdivision plan of property <br />addressed as 20 Tudor Terrace (Assessor's Map 29 Lot 198). <br />Ms. Faulkner noted there are two draft public hearing notices, one for 7:10P.M. to approve the <br />Special Permit for the cluster subdivision. The second is at 7:15P.M. for an application for <br />approval of the definitive subdivision plan for 20 Tudor Terrace. <br />MOTION: <br />Mr. Richardson made a motion to set a Public Hearing for the approval of the Special <br />Permit Cluster Subdivision for August 16, 2023 at 7:10P.M.
