16 Great Neck RoadNorth <br />wlashyee, -Massachusetts o2649 <br />Mr. Balzarini commented we are not going to take bedrooms that are already there, he <br />doesn't want to take those rights for what is being built. <br />Ms. Waygan asked how a proponent can bring forth violations and come compliant, and then <br />how does it affect this Board's modifications to the Special Permit. <br />Mr. McElhinney rejects the idea that they are not in compliance. Anything asked or suggested <br />by this Board has been attended to thoroughly. We were asked to bring forward a modification <br />for the bedrooms, and they did that in the spirit on moving forward. He does believe it has <br />grown out of proportion. He wants to remind this Board they introduced Town Counsel into <br />this matter. Without any notice to them, members of this Board met with Town Counsel in <br />early April or May, soliciting an opinion about whether they were in compliance. It was then <br />reported they were not and door to door bothering of our property owners was threatened, so <br />yes, they defended their legal right. The Chair should understand as a matter of courtesy <br />when a party is represented, our counsel directs correspondence to Patrick Costello. It's <br />unfortunate it was blown into something greater. This Board sought legal opinion. When did <br />Ms. Waygan meet with Mr. Costello? He answered back in April. <br />Ms. Waygan thinks there was a request to get information from Town Counsel, she was not <br />Chair so she dropped off the conversation. She would like to follow up with Town Counsel, <br />she has some serious technical issues about this. She does not want to go down a pathway <br />that causes a problem for anyone. <br />Mr. McElhinney would encourage a revisit to the history of this matter. It was suggested they <br />bring this as a separate modification in hopes it would get beyond that. He is now requesting <br />the right to withdraw without prejudice. He doesn't see any utility to this process. He would <br />ask the Board approve that. <br />Mr. Lehrer posed three questions previously and is still awaiting an answer. <br />Ms. Faulkner figures they are exceeding 130 bedrooms over the maximum limit, assuming all <br />configurations have four bedrooms. <br />Ms. Waygan noted this is not up to date. Any new permits that come online she would like to <br />capture. <br />Mr. Richardson thinks too much time is being spent on this and it's becoming messy. He <br />would like to move forward. The wastewater treatment hooks up many other facilities, is there <br />any damage anywhere? <br />11 <br />
