Thurston requesting a <br /> Special Permit under§174-17.1 and §174-33 of the Zoning Bylaws to allow for a raze and replace <br /> of a pre-existing, non-conforming single family dwelling on property located in an R-3 and <br /> Popponesset Overlay District(s),Map 123 Parcel 140, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on July 14, 2023 and July 21, 2023 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hail on Wednesday, August 9, <br /> 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chair, Ronald Bonvie, Vice Chair, Sharon Sangeleer, Board Member Jonathan <br /> Furbush, and Associate Members, Charles Reidy and Robert Caggiano. <br /> Attorney Christopher Kirrane represented the owners for the request to raze and replace an existing <br /> single family residential structure.This dwelling is located in the R-3 Zoning and the Popponesset <br /> Overlay Districts. The structure is non-conforming for a few reasons; the lot is entirely in a flood <br /> zone,the lot coverage is non-conforming at 100%and the wetland setback is zero feet(0 ft.).There <br /> is also a rear yard non-conformity at 12.2 feet. <br /> Attorney Kirrane stated that the proposal consists of a new two (2) story three (3) bedroom home <br /> and will be situated on the same foot print as it exists today. The house will be elevated on pilings. <br /> There are no new non-conformities being created, and is not intensifying any new non- <br /> conformities. The proposed structure coverage is under 25%at 19.8%. There are no changes to the <br /> existing setbacks or lot coverage. <br /> 1 <br />
