LaCava, Jr., as trustee of the AM <br /> LaCava Realty Trust 11 (the"Trust")has filed in the Land Court Department of the Trial Court a <br /> Complaint After Remand pursuant to G.L. c. 40A, § 17, seeking(i) that the Court vacate the <br /> August 2023 Remand Decision of the Mashpee Zoning Board of Appeals(the"Board") so far as <br /> it affinns the Building Commissioner's December 2022 decision of determination of <br /> applicability of the Special Permit; and (ii) that the Court find that the Special Permit has not <br /> lapsed.
