Legislation calls for pollution reduction and development will <br />increase that. The state approved the Comprehensive Management Plan in 2015 and relies on <br />an adaptive management approach to allow shellfish to clean the waters. We have a certificate <br />proving our wastewater plan, no development should be improved unless it can prove it won't <br />jeopardize these resources. Even projects connected to sewer cannot just be compliant. <br />Willowbend abuts water and exceeds nitrogen limits. Poppy Bay nitrogen must be reduced by <br />34%. Santuit, including Quaker Run, require 423% reduction. She referenced Troy Miller's <br />2024 letter, where he claims these 14 units, now 12, will be serviced by Willowbend under <br />DEP permit, that total nitrogen will be 50% less than if the site were developed as 3 single <br />family units. This claim is unsubstantiated by any model and by no means valid. Who has the <br />burden of proof? It is on Willowbend. Mass mitigation is required as well as consistency with <br />the watershed nitrogen plan. The Board must demand a detailed site -specific nitrogen loading <br />analysis. The Town must rigorously evaluate all development moving forward. <br />Jack McElhinney- He declares this out of order as the Public Hearing has been closed, it <br />went on for a year. This Board is allowing the public record, established over a year, to be <br />tainted by comments after public record has been closed. A Judge would say stricken from the <br />record.
