16 Great Weck RoadWorth <br />-Mashpee, -Massachusetts 02649 <br />GOALS <br />Preserve our community as best we can, keep the character. We are trying to improve <br />resiliency; they love the idea of form -based code. <br />There was a lot of talk about coastal storm flow, hundreds of people were involved with DEP <br />and a five -month window for comments, but there is still tremendous work to be done. <br />There needs to be flexibility with what can and cannot be done. A lot of people want an <br />addition but don't have the money for Raze & Replace, but we also don't want to encourage <br />tear down. There are so many different situations as people age in place. There should be <br />rules that provide incentives. Let's make it easy to improve their situations with provisions of <br />what can and cannot be done by right or waivers. People want to retire here, not move away. <br />Compensation for lost square footage when bringing a house up to current mechanical codes <br />and out of the basement level. <br />Guidance about environmental contamination. A lot is being proposed about what we cannot <br />do, but nothing is going to help solve the issues. A 100 year storm in Florida left contamination. <br />Better roadways and sewer. Sewer waste is going into Poppy Bay. We have a community who <br />is excited about trying and willing to fix this problem. We want to work with the Town and <br />Sewer Commission. <br />DISCUSSION <br />Ms. Waygan works for the Town of Yarmouth. They are sewering and starting to inspect <br />rentals and cap occupancy based on septic size, that includes short term as well. <br />The BOH has a new regulation, within 300 feet of a water body, anything substantial you must <br />do an Al system, that won't apply to those on sewer. <br />There is a fear that Raze & Replace encourages the selling of homes to a builder or agency <br />that will build a mansion, but this says an addition will cause detriment. There is also concern <br />of floodplain, where some property owners are in and some out, but this applies to all in <br />Poppy. <br />If you take Raze & Replace to a point it doesn't motivate people to use it. Under state statute, <br />a preexisting nonconformity, you can expand and create new while leaving up one wall. <br />Ms. Waygan noted the bylaw can fix that. Regardless of case law, it comes in when there is a <br />dispute. We can deal with that. She is very concerned about nonconformities. <br />5 <br />
