16 Great Weck RoadWorth <br />.Mashpee, Aassachusetts 02649 <br />Mr. Pesce noted on page C-5.1, a stone sign with a couple of pillars inside a 4X8 open area <br />where an oval sign will be placed. This looks acceptable and the location is shown on the site <br />plan. <br />Mr. Lehrer stated the detail sheets are referenced, and Ms. Waygan noted to strike condition <br />number 5. <br />Mr. Yergatian moved to number 6, it says street sign and he thinks it should say light, and it <br />says across from subdivision, but that is not owned by applicant. It requires streetlight to <br />illuminate the new intersection as shown on the site plan. <br />Mr. Lehrer also noted condition number 4 should read 40ft. front setbacks and 15ft. for side <br />and rear. <br />Mr. Pesce inquired about number 14 and securing a construction surety before endorsement, <br />but this is bound by a covenant. Generally, a covenant is referenced alongside the plan, so he <br />is asking that reference be made. <br />Mr. Lehrer stated the covenant agreement can be signed the same time the subdivision plan is <br />signed, so both can go to Registry of Deeds. Once the covenant is recorded, it binds <br />installation of utilities before the permit can be issued. There is a requirement to install utilities <br />and give access via road. A covenant is the first mechanism. It says no building permits can be <br />achieved until requirements are complete. The legal agreement says you will not get permits <br />before recording at registry. Its already written. <br />Ms. Waygan would like to strike the word customarily under condition 8 regarding construction <br />hours. She would like to remove the word substantial to number 12. If something is trivial and <br />cannot be met, then the Board can amend. The applicant requested a waiver from section 9 of <br />the rules and regulations governing the installation of sidewalks <br />MOTION: <br />Mr. Balzarini made a motion to waive the regulation in Section 9 of the Rules and <br />Regulations, that sidewalks be installed. Seconded by Mr. Oakley. All in favor. <br />Mr. Pesce would like to see the area used for stormwater management to have a fence for <br />safety. The applicant needs to show the gate, even if tentatively, and figure out the actual <br />location. The solar bylaw requires a 6-inch gap above the ground to allow the passage of <br />wildlife. <br />MOTION: <br />Mr. Balzarini made a motion to close the Public Hearing. Seconded by Ms. <br />Faulkner. All in favor. <br />3 <br />
