4 <br />Select Board/Finance Committee <br />Minutes <br />October 21, 2024 <br />CONVENE JOINT MEETING WITH THE FINANCE COMMITTEE <br />Reyiewx Discussion and Possible Action on Annual Town Meeting Warrants with the Town <br />Counsel Finance Committee and the Town Moderator; <br />Prior to the Annual Town Meeting, the Select Board met with the Finance Committee and the Town <br />Moderator to. review matters associated to the warrant. Finance Committee members in attendance; <br />Jamie Schuh Chair, Darlene Furbush Vice -Chair, Lee Smith Clerk, Gregory McKelvey, <br />Jeffrey Pettengill, Michael Milbury and Richard Weiner. John Miller, the Town Moderator and <br />representation from KP Law; Town Counsel were also present for discussion purposes. <br />Arden Russell, Chair of the Community Preservation Committee (CPC} was also in attendance. <br />Acting on the recommendation of Town Counsel to amend the motion to Article 2, the topic was <br />reviewed and discussed by the attending individuals. <br />Selectman David W. Weeden present: 6:09 p.m. <br />There article as written authorizes the Conservation Commission to assume the care, custody and <br />control of the parcel located at 475 Nathan Ellis Highway. In discussing this matter, it is <br />recommended the article would be better served under the care, custody, and control of the Select <br />Board as it is likely there would be further discussions regarding the intended use of the parcel. <br />Therefore, the amendment would substitute the word: Conservation Commission under the <br />provisions of GL c. 40, §8C with the language: , ..which parcel shall be under the care, custody and <br />control of the Select Board acting as Parks Commissioners. <br />It was noted there are many uses for the 7-acre parcel which has access to John's Pond. If for <br />recreation, there are several possible uses. The site includes an existing dock and an 8-bedroom, 4- <br />bath 2,764 square foot dwelling. <br />Language in the motion provides the authorization for the Select Board to grant a permanent <br />conservation restriction on the parcel as required by the Community Preservation Act. Due to the <br />back -log with the state, a temporary conservation restriction may be considered. <br />Discussion followed with respect to the language of the draft article to acquire said parcel by <br />purchase, gift, and/or eminent domain for open space and recreation purposes. <br />
