Executive Session 9/20/95 <br /> sinca it wasn' t recorded, building permits shouldn' t be isSUed. <br /> Chairman Ferri-_tgamo said -the Board may have suggested to Mr . <br /> Fudala that he inform the Building Inspector of Town Counsel ' s <br /> memo. The Board asked Mr . Fudala to check records on <br /> correspcindence, and to contact the Building Commissioner to see <br /> what his, understanding was from the letter as to issuing building <br /> permits. Chairman Ferragzainct said by someone saying they weren' t <br /> issued a building permit because the special permit was never <br /> recorded, makes Mr . Sullivan' s case t0i Subdivide his property. <br /> He said either the special permit is good and Mr. Sullivan cant <br /> subdivide, or the special permit is invalid and Mr . Sullivan c-an <br /> subdivide. <br /> Chairman Ferragamo said he can't see how anyone was irreparably <br /> harmed as no one has appealed to the Zoning Board of Appeals, <br /> which is their- full recourse to get a permit . <br /> The Board will notify Town Counsel that Mr . Sullivan brought up <br /> this issue that the Planning Board through its members had <br /> violated pec-iple' s -:ivil rights who, own lots in the other <br /> subdivision. They will also ask Town Counsel if the teszhnical <br /> issues should be part of the motion or not . <br /> On a MOTION made by Mr . Coffey and SECONDED by Mr . <br /> Balzarini it was unanimously voted by roll call vote of <br /> Mr . Ferragamo, Mr . Coffey, Mr .
