MASHPEE ZONING BOARD OF APPEALS <br />NOVEMBER 9, 2011 <br />MINUTES <br /> addition of the garage improves the available parking. <br /> the irregularly shaped lot creates a hardship to conform to setback <br />requirements. <br /> Because the subject property is surrounded by streets, it has two front <br />setbacks. <br /> the proposal has received Board of Health approval. <br /> <br />The Decisions are conditioned upon compliance with the following: <br /> Conservation Commission approval. <br /> Board of Health approval. <br /> Warwick & Associates, Inc. plan entitled: “Site Plan Proposed Garage and Pool <br />For James L. Galvin III, Trustee, 27 Popponesset Island Road, New Seabury, <br />Mashpee, Mass. Date: 04/25/2011, Rev: 09/16/2011”. <br /> RESCOM Architectural Inc. plan entitled: “Floor Plans & Site Plan. The <br />Galvin Residence 27 Popponesset Island Road New Seabury, Mashpee, <br />Massachusetts. Date: 08-16-11”. <br />Mr. Furbush seconded the motions. Mr. Nelson voted yes. Ms. Horton voted yes. Mr. <br />Reiffarth voted yes. Mr. Blaisdell voted yes. Mr. Furbush voted yes. Vote was <br />unanimous. <br /> <br />James and Katrina A. Cannatelli: Request a Written Finding under Section 174-17 of <br />the Zoning By-laws to allow for construction of an addition to a pre-existing, non- <br />conforming dwelling on property located in an R-5 zoning district at 29 Sheffield Place <br />(Map 29 Parcel 178) Mashpee, MA. <br /> <br />Sitting: Board Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell, <br />James Reiffarth and Associate Board Member Judith M. Horton. <br /> <br />Material submitted: Photos of the subject property and subdivision plan. <br /> <br />Ms. Jean Bowden of Capizzi Home Improvement represented the Petition and <br />submitted photos of the subject property. She stated that the Petitioners would like to <br />add an 18x16-foot great room/family room to their pre-existing, non-conforming <br />dwelling. She said that the property is surrounded by plenty of open space and woods. <br />The proposed addition will not be visible from the street, back or right side of the <br />dwelling. <br /> <br />Mr. Nelson commented that the certified plot plan shows part of the subject property <br />lies within the layout of the road. Ms. Bowden submitted a copy of the subdivision <br />plan. She said that she conducted a search at the Barnstable County Registry of Deeds, <br />but she did not discover any takings by the Town on the subject property. Although Mr. <br />Nelson said the plan should define the layout of Sheffield Place and reflect the <br />conditions as they exist today, he also said that these details would not prevent the <br />Board from reaching a Decision on the proposal. <br /> <br />No comments were received from abutters. <br /> <br /> 3 <br /> <br />
