Barber and Donna Barber Bk#: 15553 <br /> 166 Wheeler Road Page#: 259 <br /> (Map 49 Parcel 9) <br /> Mashpee, MA 02649 <br /> A Petition was filed September 14,2016 by Owners, Stephen D. and Donna Barber <br /> requesting a Variance fiom the side yard setback under §174-31 of the Zoning Bylaws to <br /> allow for construction of a detached 24' x 28'-two car garage on property located in an R- <br /> 5 Zoning District, at 166 Wheeler Road, Map 49 Parcel 9, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on September 30, 2016 and October 7, 2016 <br /> a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 9, 2016 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Board Member, Dom DeBarros and <br /> Associate Members,Brad Pittsley and Norman J. Gould. <br /> Mr. Collins O'Connor, Builder represented the applicants for the garage project. <br /> He's asking for 13 foot variance on the southerly side of the lot to construct a two car <br /> garage. He plans to remove the shed and fabric building. The driveway will not be over the <br /> septic system. <br /> Chairman Furbush read the Inspection Department comments, and Conservation <br /> Comments into the record. He read the Board of Health comments into the record; "no <br /> habitable space above garage. Septic inspection is required prior to building permit sign- <br /> off." He read the DPW comments into the record and will be part of the conditions. <br /> There were no further comments from the Board or the audience. <br /> 1 <br />
