lbwn ofAlashpee <br /> 16 6"weat oM\ r*1{mutt„lvi llt <br /> Mr silpt-e, Wo?"(1chusrits 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2016-40 <br /> Jason Stone, Trustee Lot#: 82 <br /> of the Jason Stone Trust Plan#: 11408-23 (Sheet 2) <br /> 156 Waterway Doc. #: 1193511 <br /> (Map 105 Parcel 238) Ctf. #: 197310 <br /> Mashpee, MA 02649 <br /> A Petition was filed on August 11, 2016 by Jason Stone requesting a Written <br /> Finding under §174-17 of the Zoning Bylaws to raze and replace a single-family dwelling <br /> on property located in an R-3 Zoning District, at 156 Waterway, (Map 105 Parcel 238), <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise,a newspaper of <br /> general circulation in the Town of Mashpee, on August 19, 2016 and August 26, 2016 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 14, 2016 at which time the following Board of Appeals members <br /> were sitting in on this hearing; Chairman, Jonathan Furbush, Vice Chairman, William <br /> Blaisdell, and Board Members, Ron Bonvie, Dom DeBarros, and Associate Member, <br /> Norman J. Gould. <br /> Attorney Kevin Kirrane represented Mr. Stone for the raze and replace single- <br /> family dwelling application.He stated that he would like to withdraw the Variance request. <br /> He provided the Board a narrative,photos of the area and existing house projects, a revised <br /> plot plan and house plans. <br /> The lot consists of 16,350 sq. ft. of upland area, has 100 ft. of frontage along <br /> Waterway and is bounded by Popponesset Creek. The existing three bedroom dwelling is <br /> situated on the lot, with an accessory float and dock complex. Currently the building <br /> conforms to the setback requirements of the side yard and the setback requirements from <br /> the front yard. It does not conform to the 50' ft. setback requirements to the wetlands, <br /> which was a bylaw adopted long after these houses were constructed. <br /> 1 <br />
