Egasti, Trustee Doe. #: 1019882 <br /> 23 Cordwood Road Ctf. #: 178644 <br /> (Map 112 Parcel 83) <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 12, 2016 by Jane H. Egasti, Trustee requesting a <br /> 4 ft. Variance of the side yard setback under §174-31 of the Zoning Bylaws to allow for <br /> extension of an existing garage on property located in an R-3 Zoning District and <br /> (Popponesset Overlay), (Map 112 Parcel 83), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on February 19, 2016 and February 26, 2016 <br /> a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 9, 2016 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Ron Bonvie, Scott Goldstein, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Doug Mullen, General Contractor represented the applicant. He will be <br /> extending the garage that is falling apart and would like to add a second story, 2.5 ft. on <br /> the North elevation. It's a pre-existing non-conforming structure. <br /> Chairman Furbush read the comments from the Board of Health into the record; <br /> "Allowed as long as space remains unheated." <br /> Chairman Furbush read the Inspection Department comments into the record; <br /> "The area is zoned R3 and is in the Pre-contact Archaeology Sensitivity area— listed as <br /> "Moderate Sensitivity". The applicant is seeking a Variance under Article V §174-31 to <br /> construct an addition to an existing free standing garage;which would be too close to the <br /> side yard setback." <br /> Chairman Furbush read an email from the abutter at 22 Bluff Avenue dated March <br /> 8, 2016,who had specific concerns. <br /> 1 <br />
