Deery for a Special Permit SP-90- 1�04 <br /> Petition was filed by William J. and Gertrude M. Deery of <br /> Mashpee, 'Massachusetts for a Special Permit under Section 174. .5.I.9 o <br /> the Zoning By-laws for permission to mere and reconstruct an existing <br /> pier in an R-3 zoning district on property located at 122 Captain's Row <br /> lap 9 , Block 19 Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Leas Chapter 4 A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on December 22 and December 29, 1989, a copy of which is -attached hereto <br /> and made a pant hereof. <br /> A public hearing was held on the Petition at the Mashpee "Town Mall <br /> on Wednesday, January 10, 1990 at 7: o p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Ha ver, Michael A. Makunas and William J. Harnrahan. <br /> Gregory Taylor of Taylor Design represented the Applicant. <br /> He informed the Board that Mr. Deerr had owned the dock for 20 years <br /> and learned that most of his dock was not oni his property. He <br /> requested permission to remove the existing pier and float and <br /> relocate it. Comments were received from the Shellfish Constable stating <br /> that he had no objections to the new location. <br /> The Board determined that the use is in harmony with the general <br /> purpose and intent of the Zoning By-laws and complies with the <br /> provisions set forth within the By-laws. The Board requested <br /> new set of plans eliminating proposed steps. <br />
