Valletta Bk.: 35107 <br /> 112 Captains Row Pg.: 119 <br /> Map 96, Parcel 17 <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 2, 2024 by Owner, Robert M. Valetta requesting a Written Finding <br /> under §174-17 and §174-33 of the Zoning Bylaws to remove an existing pool/spa and replace it <br /> with a new slightly larger pool/spa on the same existing patio on property located in an R-3 Zoning <br /> District, at 112 Captains Row, Map 96, Parcel 17, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on July 5, 2024 and July 12, 2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition at Mashpee Town Hall on Wednesday, July 24, 2024. <br /> Mr. Kieran Healy,with BSC Group represented Mr. Valletta's request for a Written Finding under <br /> §174-17 and§174-33 to replace an existing pool/spa with a new spa.The application was approved <br /> by the Conservation Commission. Mr. Healy provided photos of the area,and a certified site plan. <br /> The new spa/pool will be 9 ft. x 19 ft. to the exterior walls. The lot size with the new wetlands <br /> regulations is currently 18,686 sq. ft. to 6,819 sq. ft. will be 11,867 sq. ft. of wetlands. The lot <br /> coverage will increase from 3 8.8%and to 40.1%. <br /> The Board had a discussion, and continued the hearing to afford the applicant to provide the <br /> standard lot coverage computation included on a revised site plan. The Board also required that <br /> the measurement of the retaining wall in the rear is under 4 ft., otherwise it would be considered a <br /> structure. <br /> A Public Hearing was held at the Mashpee Town Hall on Wednesday, August 14, 2024 at which <br /> time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Ronald Bonvie, Board Members, William A. Blaisdell, Jonathan Furbush, Scott <br /> Goldstein and Associate Member, Charles Reidy. <br /> 1 <br />
