MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner,Joseph M. Donovan <br /> 32 Cordwood Road, Map 118, Parcel I <br /> Mashpee, MA 02649 <br /> SP-2024-38 <br /> The rear yard setback is currently 14 ft., and will become conforming at 15 ft. The setback from <br /> the Way Rd. will be improved from 11 ft. to 15 ft.,thereby eliminating two nonconformities, and <br /> improving the third nonconformity. There will be a new UA septic system installed, it will be <br /> building code compliant with dry wells and there is no increase in the bedroom count. There are <br /> no new nonconformities being created, and there is no intensification of any existing <br /> nonconformities. <br /> GENERAL FINDINGS <br /> The Board of Health comments dated July 23, 2024 were read into the record; "No comment to <br /> remain 3 bedroom with the addition of IIA septic system per Mashpee 1000 foot I/A regulations. <br /> The Conservation Department comments dated July 17, 2024 were read into the record; "Not <br /> within wetlands jurisdiction. " <br /> Mr. Goldstein asked if the 2nd floor cantilever is considered part of the lot coverage. Mr. Morris <br /> said it is 2 ft. and is not considered part of lot coverage. <br /> Attorney Kirrane stated that the shed is being removed, and was included in the lot coverage <br /> calculation. <br /> The subject property located at 32 Cordwood Road has 7,181 sq. ft. of land. The subject lot is <br /> located within the Popponesset Overlay District. The minimum dimensional requirements in the <br /> Popponesset Overlay District are as follows: <br /> Minimum Lot Size -6,000 square feet <br /> Minimum Frontage—60 feet <br /> Minimum Front Yard Setback—25 feet <br /> Minimum Side and Rear Yard Setbacks— 15 feet <br /> There were no abutters present. <br /> SPECIAL PERMIT CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses <br /> §174-17.1 Raze and Replace History:Added 10-15-2018 ATM,Article 16,approved by Attorney <br /> General 1-9-2019. <br /> 2 <br />
