Town of Mashpee <br /> « 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2024-30 <br /> Owners, Christopher Kilburn and Doc.: 1485074 <br /> Maureen Kilburn Ctf.: 233552 <br /> 37 Driftwood Circle <br /> Map 125, Parcel 197 <br /> Mashpee, MA 02649 <br /> A Petition was filed on June 3, 2024 by Owners, Christopher and Maureen Kilburn requesting a <br /> Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for construction of a <br /> three season porch to a pre-existing,nonconforming dwelling on property located in an R3 Zoning <br /> District and the Little Neck Bay Cluster Subdivision, Map 125, Parcel 197, Mashpee MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on June 14, 2024 and June 21,2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,July 10,2024 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, Jonathan <br /> Furbush, and Scott Goldstein. <br /> Mr. and Mrs. Kilburn presented their application request for a Written Finding. They would like <br /> to enclose the existing deck on the rear of their home. They provided the Board with a site plan <br /> and building plans depicting the existing deck in the rear of the dwelling. The existing deck is <br /> situated 19.3 ft. from the rear yard setback where 20 ft. is required in the Little Neck Bay Cluster <br /> Subdivision. There is no expansion of the original dwelling footprint. The Building Commissioner <br /> referred this application to the Zoning Board because the property is located within the AE-11 <br /> Flood Zone and requires relief from §174-33. <br /> The Board reviewed the site plan and there were no issues with the project. <br /> 1 <br />
