Seymour Ctf.: 149771 <br /> 1 Nehoiden Road <br /> Map 125, Parcel 108 <br /> Mashpee, MA 02649 <br /> A Petition was filed on June 3, 2024 by Owners, Gerald C. and Linda V. Seymour requesting a <br /> Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for alteration, and <br /> extension to a pre-existing,nonconforming detached garage on property located in an R-3 Zoning <br /> District, Map 125, Parcel 108, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on June 14, 2024 and June 21,2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,July 10,2024 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, Jonathan <br /> Furbush, and Scott Goldstein. <br /> Mr. Gerald Seymour represented himself for a Written Finding request to construct an apartment <br /> above a pre-existing, nonconforming garage. The lot is pre-existing nonconforming totaling <br /> 17,206 sq. ft. of land area. The property is surrounded by the floodplain, but was issued a LOMA <br /> #18-01-1411-A on July 16, 2014, and is now removed from the mapped floodplain. The 17,206 <br /> sq. ft. is all upland. The frontage is conforming from both Nehoiden and Great Oak Road(s). The <br /> front setbacks are nonconforming: the house is setback 37.3 ft. from Nehoiden Road, and 29.3 ft. <br /> from the edge of Great Oak Road. The lawfully pre-existing detached garage is located 1.5 ft.from <br /> the easterly property line. The rear setbacks from the house to the northerly lot line conforms, <br /> however, the garage is currently 13.6 ft. from the lot line where 15 ft. is required. Lot coverage by <br /> structures currently totals 15%. The proposed lot coverage will increase to 16% and is under the <br /> 20% requirement. <br /> 1 <br />
