Mizzi request a Special <br /> Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze and replace a pre-existing, <br /> nonconforming single-family structure on property located in the R-3 and Popponesset Overlay <br /> District(s), Map 117, Parcel 96, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on July 26, 2024 and August 2, 2024 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, August 14, <br /> 2024 and continued to September 11, 2024 at which time the following members of the Board of <br /> Appeals were present and acting throughout; Chairman,Ronald Bonvie, Board Members, Sharon <br /> Sangeleer, William A. Blaisdell, Jonathan Furbush, and Associate Member, Michael Milbury. <br /> Also present was David Morris, Building Commissioner. <br /> Attorney Christopher Kirrane represented�the homeowners for the raze and replace project located <br /> at 54 Kim Path. The lot is also located in the Popponesset Overlay District with the dimensional <br /> requirements being 6,000 sq. ft. of lot area, 60 ft. of frontage, 25 ft. front yard setback, and 15 ft. <br /> on the side and rear setbacks, 25% lot coverage, and a 50 ft. setback from wetlands, and a 30 ft. <br /> height restriction. <br /> This project has four nonconforming conditions. The lot is completely within the flood zone, so it <br /> has zero sq. ft. of lot area based on the new flood zone regulations. The other nonconforming <br /> existing conditions are; 7,125 sq. ft., lot area, 50 ft. setback from wetlands, 100% lot coverage, <br /> and the southwesterly side yard setback is currently 13.4 ft. <br /> 1 <br />
