Barry, Trustee of the K&M Realty Trust <br /> 3 Pinecrest Avenue, Map 49 Parcel 168 <br /> Mashpee, MA 02649 <br /> FINDING-2024-43 <br /> SPECIFIC FINDINGS <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday,August 14,2024 the <br /> Zoning Board of Appeals voted unanimously to issue a Written Finding to Owner, Lorraine E. <br /> Barry, Trustee of the K & M Realty Trust under §174-17 of the Zoning Bylaws to allow for <br /> construction of a three-season room above a pre-existing, nonconforming attached garage on <br /> property located in an R-5 Zoning District, at 3 Pinecrest Avenue, Map 49, Parcel 168, Mashpee, <br /> MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. As-built Plot Plan—Lot 104 Pinecrest, Prepared by Land Use Technology, Inc., Job No.: <br /> 81-1385, Date: 11/26/88, Client: Barry, Scale: 1" — 40'. Stamped and signed by: Charles <br /> Scott Kennedy, Professional Land Surveyor, No.: 12454. <br /> 3. Building Plans — Prepared for: 3 Pinecrest Ave, Mashpee, MA. Proposed Season Room, <br /> Date: 12/20/23, Prepared by: JB Designs. <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Board of Health and Conservation Department comments. No heat can be <br /> added at any time in that proposed area. <br /> 5. Any changes to the plan will require the applicant to return to this Board. <br /> 6. The Board finds that the proposed project under §174-17 is not substantially more <br /> detrimental than the pre-existing,nonconforming structure or use to either the Town or the <br /> neighborhood. <br /> 4 <br />
