Town of Mashpee <br /> w <br /> r? k,;• 16 Great Neck Road North <br /> M= <br /> J Mashpee, MA 02649 <br /> ,0'1' <br /> o,Dill ' <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2024-46 <br /> Owners, Lisa Jacobs Conti and Doc.: 1408839 <br /> Christopher Conti Ctf.: 224045 <br /> 45 Popponesset Island Road <br /> Map 106, Parcel 14 <br /> Mashpee,MA 02649 <br /> A Petition was filed on July 23, 2024 by Owners, Lisa Jacobs Conti and Christopher Conti <br /> requesting a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for <br /> construction of a 252 sq.ft.addition to a pre-existing,nonconforming structure on property located <br /> in an R-3 Zoning District, at 45 Popponesset Island Road, Map 106, Parcel, 14, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee,on August 9, 2024 and August 16, 2024 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, August 28, <br /> 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, <br /> Jonathan Furbush, and Associate Member, Charles Reidy. Also present was David Morris, <br /> Building Commissioner. <br /> Attorney Christopher Kirrane represented the homeowners for their Written Finding request under <br /> §174-17 and §174-33 of the Zoning Bylaws located at 45 Popponesset Island Road to add a 252 <br /> sq. ft. addition to the existing single-family dwelling. This property is located in the R-3 Zoning <br /> District which has a minimum lot area of 40,000 sq. ft., a minimum requirement of 150 ft. of <br /> frontage, 15 ft. side and rear side yard setbacks,20%lot coverage,and a 50 ft. setback to wetlands. <br /> There are four nonconformities on this lot. This lot contains 16,360 sq. ft.of land,is entirely in the <br /> flood zone, and for zoning purposes there is zero square feet of lot area. <br /> The front yard setback to Chart Way is 30.5 ft.where 40 ft.is required. The setback to Popponesset <br /> Island Road is 21.2 ft. where 40 is required, and the rear yard setback to Popponesset Island Road <br /> is 6.2 ft. which is a nonconforming condition. <br /> 1 <br />
